If you go the route of Bankruptcy... file Chap. 11 reorganization.& Any payments made to creditors must be applied to the principal -- they collect no interest... which reduces the principal that they can charge interest on.

IRS SUMMONS motion to quash

This is my first post on this site and I am really impressed with the quality and sharing of information.



My story is that the last time I filed with the IRS is 1999. Have gotten some letters from them about not filing and requests to do so, even sent a reply to them on one asking for their authority among other things.



Anyway, last week I received two certified letters from bb saying that they have summoned my employer and mortgage company for information about me, third party. The cover page informs me that I can petition to quash the summons and has directions on how to do it.



My contention is that the law was repealed and not re-enacted and that the code has no legal effect upon me if I challenge and rebut the code so it is not used as prima facia evidence.



Anyone have any opinions that might help? Just looking for educational material, not legal advise.

Thanks for your reply. I have setup to get on the lawwork forum last night and am waiting to be accepted as a member.



I have been on many sites previously, nite, taxgate,eddy kahn, looked into redemption, and am still signed up with Larken Rose. I've even got 50 some hours of Jack Smith audios that I have listened to and also Don Ray. This site is awsome!!!



What I plan on doing is filing a petition to quash the third party summons on the grounds that there is NO legal standing for any of the Title 26 codes. Title 26 is NOT POSITIVE LAW and only matters in a legal sense if it is not challenged and rebutted. I am looking for any form example to write the petition. I also will file an affidavit of negative averment to hopefully force them to prove that Title 26 is valid or get off my back. Any help will be appreciated.



Just looking for educational material, not legal advise.

I've been very impressed with Jennings stuff but I have had no success at all in logging onto his website or finding an email address. I do have a snail mail address that I am going to write to today.



Anyone with info on Jennings please let me know.
