irs letter: "critical readers" will have fun



Hi, all....


Here's a link. I've posted my most recent letter from the IRS. You "critical readers" are going to have way too much fun. For those of you still "new" to battling the IRS, this'll help in your education.& Please note it's taken them four years to get to this point.

Hey, Tora, what's up?


14 hours in my truck today, so tonight, no response. Feeling too "beligerent," if you know what I mean. (For example, I'd love to say--and just might--regarding the "we didn't get your return" stuff, something along the lines of:


"And you're going to believe me if I say simply I never received your alleged requests for these returns?" And so forth. (Pushing their buttons is way too easy.)


I loathe the repititious use of "we." "We" did this, "we" did that. I loathe the use of "we" by a single "person."


Do re-read it, JUST the last line, referencing the "whom" I am to contact, the "person named" in the letterhead. That "name" is--wait for it.......hold on....this is so cool.....are you ready?


I am to contact a Mr./Miss/Ms./whatever "Tax Technician."


And yes, that IS how I will start my letter.


But the substance will be painfully short. I'm weary of all this.


I'll feign confusion at his use of "these sections...and the regulations there under..." (however he said it). I.E., are the "sections" his "authority," or do the "sections" merely imply OTHER "regulations" to be found elsewhere?


I will quote those sections, for his benefit, since they state oh so clearly that there must FIRST be a liability before they can do anything and, obviously, they have not, and can not, prove "liability."


I'll probably point out how, on one hand, he's "threatened" penalities while, on the other and simultaneously, penalties have already been applied.


I'll "remind" him that assessment authority rests solely with the "Secretary, or his delegate," and I'll demand to see his delegation orders.


See what&I mean? A fully detailed response could easily run a hundred pages.


Oh. And bet the farm he's going to get a bunch of court cases regarding his attempts at having me waive my rights! Whether he likes it or not, the Bill of Rights is still alive and well and applies in tax matters, both civil and criminal.


I'll demand to see the assessment, with HIS name SIGNED, and done so under penalty of perjury.


I'll demand to see all this "evidence" he used, you know, the w-2's, etc, and I'll quote the federal rules of evidence that ALL such materials MUST be certified/authenticated copies (if NOT the originals).


Tell you what. If you want, when I'm done, I'll email you a copy. How's that?& Might take a few days. Monday is Lisa's birthday (my wife). Taking her, our two daughters, and our older daughter's fiancee to Appomatox and then over to the Natural Bridge zoo.


I "should" be able to have it done Sunday, however. Just let me know.

What a letter.& It still comes back to the fact- are you a taxpayer?& You could respond with a CPN in the amount that they have said you owe.& I am in the process of doing one for Alabama.& Then if they don't except it you can do the letter of nonresponse, and all th while keep increasing that paper trail.& Just an idea.


I have finally learned that you don't have to file you Ucc1 to use the administrative remedies.& Jerseee put his VOD package&with the CPN in the download section.& You could look at that and see if&it could be adjusted to fit this situation.& I look at the&irs and state tax departments as debt collectors anyway.& &

<FONT size=3>I have sent IRS&a few darn good letters myself(written by other people)&and nothing has ever stopped them.& NOTHING. You can cite them&a &TON of law, but&they just keep&on truckin.</FONT>

Hey, I notice they are now putting in a mock answer to the Privacy Act of 1974. However, they are using sections that apply to those with a liability.

Also, they indicate that they received no response from you. From what I've read in other sections, you never miss an opportunity to respond.

Looks like just another computer generated letter that gets sent to anyone with Parizek's fake signature on it.

Randy,

this is very simple. Make copies of this letter and send them a CPN for the full amount. Write a cover letter asking for verification and show that you tendered a good faith payment as well.

Wait for them to refuse your payment and go from there. Don't argue about it.
