Doesn't matter. The employer IS going to file, with the IRS, W-2s, 1099s, and all the rest. That's ALL the IRS needs, or wants. They'll take it from there. They have "information returns," you name and address, they'll create a SS# for you, and they'll create substitute returns, and then they'll "come after you."

But the IRS doesn't play fair.
Admit to being an "employee" and your "wages" become "income" and you've admitted to being engaged in a "business activity" and you become a "Sole Proprietorship."
Admit to being a "non-liable INDIVIDUAL" and you have a contradiction in terms that will be used against you.& You must not admit, or acknowledge, anything beyond being "Non-liable."
The only "argument" they will ever, ever accept as being "non-frivolous" is a signed return (yours or theirs), along with payment. Everything else brands you a "tax protestor."
These bastards know all this stuff better than you and me. They simply don't care about "truth." The law is on their side. The judges are on their side. The public is on their side.&They have a "job" to do, and that's to collect as much money as they possibly can on behalf of BB. That's it. That's all it is to it. There's nothing more.

Thought I'd add this. Purely anecdotal, I know, but it speaks volumes.&
In almost five years of dealing with these agents, I've noticed a couple of things:
Rarely do any of their letters use the standard postal address. I.E., their return address spells out the state. They do NOT use VA, for Virginia, for example. Why not?
My name is always spelled in all caps. The person to whom I am respond? His/Her/Its name is NEVER spelled that way. Just a matter of "form"?& Gotta wonder.
The point is, again, they know all this stuff. All--without exception--all our "arguments" have been summarily dismissed as frivolous. We're back in time, trying to convince a nation that the world is round, NOT flat.&We're outnumbered by those who still believe it is flat. We're out-gunned by those in power.
So why do it?
Because it's the right thing to do. Because I, for one, won't be a&slave. Because I, for one, have learned too much to go back. I won't be told that black is white when I know it's black but unless I agree to PRETEND that it IS white, well, they might do this and might do that because they have the power, blah blah blah
I've said it before. It bears repeating:
I HATE BULLIES. The IRS is a bully. I hope it goes to hell and dies.
