D.C. Photo Enforcement
Anyone know about Photo Enforcement in D.C. I recieve a Phote enforcement that took place 3 months ago and just now recieved it

They have one in chicago, and it take about a month to get it in the mail, and it will cost you $90.00 dollars to pay it off. No contest, because you are on candid camera.

How does this photo enforcement work, as in how do you become eligiable for one?
Why can't the photo be contested? How can anyone cross-examine (face your accuser) a photo? Suppose the camera is not set up properly? Maybe you have a twin brother or sister? Like a traffic ticket, the photo seems to be prima facie evidence, it can be rebuted.

The ticket isn't issued against a person -- it's against the vehicle.
The camera takes a picture of the license plates. The clerks look up who the plates are assigned to and they send the ticket to them.
No points assessed, since they can't prove who was driving, just a fine.
If your state doesn't have an agreement with D.C., there's very little that can happen if you don't pay (except for getting the car booted next time it's in D.C.).
If the state DOES have an agreement, eventually, you won't be able to renew your registration.

However, that vehicle has an owner, why can't the owner contest the ticket? Or are you saying that the state ownes all vehicles?

Clerks sometimes make errors, thus, why should the Photo not be contestable?

It take a snap shot of your license plate number, and model of your car, when you failed to yield for the stop light while on red, or take off while the light still on red. All this informations has been coded into the camera as a computer analysis, if you will.

You just said it , "prima facie evidence" that is what it is. If your license plate is not taking, then you have a chance to rebuttal it.
For instance, when you have a bag full of gold recorded in the camera while you count it , it's hard to confuse the jury or hearing officer that you find it empty.

I never said that the ticket couldn't be contested.
I merely explained how the process works.
Just like any other ticket, it can be contested. However, given that there is a photograph of the car, the license plate, and the red light; it will be a hard case to beat.
One of the most successful approaches has been to compare the speed limit with the length of time the light stays yellow. It is somesimes possible to prove that the signal doesn't give enough time for a car to stop before the light turns red.
