Interest & Penalties

Small business/ Self employed area: Farming (Non livestock).

May of 2001, IRS notified me that my 96, 97 & 98 tax returns were short in payment of about $48,430.73. I then hired a different book keeper and at home re-worked the numbers and low and behold the IRS was correct in their figures.

I explained to their office that I had to change bookkeeper, but that didn't matter. Now their office wanted extra thousands $$$ for late fees & penalties. I said no way it isn't right!

Low and behold here comes the notice of liens & levys plastered all over the county, state and country.

I tried to work this out over and over again with these idiots and as a result these parasites now want more in interest & penalties than what the original tax was alleged to have been.

Just the other day when agent x showed up at the farm lurking around counting corn kernels I once again offered to pay the original alleged tax and he refused. I figured he, being a private collection agent, must be getting a good commission for his effort, if any?

I would like to settle this matter without having to go to court. I have already notified the register of deeds & county commissioners of the unlawful activity of the notice of lien(s) not being actual liens, and they all just went silent... not a peep!

I thought that the IRS, when offered payment, would have to accept. Could be I am incorrect in my theory?

I am new to this site and would appreciate any ideas for educational purposes.

In the meantime...

If you know anybody who is incarcerated illegally or unlawfully and would like to get out, I have an affidavit that seems to be working pretty good in this area of a "get out of jail free card" type theory that I can send to whomever requests.

This site is free for all to offer any and all information that is helpful to the cause of redemption and freedom. So you may contact Sui Juris to post your document so that it may help others.& Now with that said, I offer a potential solution to your situation.& But you must keep in mind that this is not legal advice--only a sovereign's opinion.


The first thing you could do to help yourself is to stop arguing about the alleged debt.& the next thing you could do is let it go to court.& When and/or if it goes to court demand that the IRS verify the alleged debt.& And if they can verify it, ask for the settlement offer.& If they say that you owe $48K--then tender a CPN right there on the spot.& If they refuse that--they are now in dishonor and have refused payment.& Furthermore, they are not immune from public policy.& I offer the recommendation of taking the path of least resistance and accept everything they say until they are in dishonor.& You have remedy.& I hope this leads you to some sort of resolution in your favor.

Thanks for taking the time to respond. I have read & comprehend what has been posted in the substitute return portion herein this site.

I think that I will have a F.O.I.A. sent to the main District Office that oversees this respectfully ignorant alleged collection agent, to find out exactly what his identity is, or is not?

I do not know how to cut & paste on this computer yet. Nor do I have the time at present to learn. However, I did contact "the man" who does this work for me, when asked, and he will load up the hard copy and send to the addy provided here.

You can "discharge" the alleged debt with a BoE, sending the VOD to the IRS.& You would need to document every step of their dishonor so that you can get the liens removed.

[color=black][b]This is concerning Frivolous Penalties under IRC 6702. Here is the duty they must do to impose it:<BLOCKQUOTE>20.1.10.9.2Â* (08-12-1998)

Assertion

1. Generally, the service center identifies frivolous returns and assesses the penalty.



2. If the field receives a return that warrants a frivolous return penalty, the employee should indicate this on a Form 3198, Special Handling Notice, attached to the original return.



3. A Form 8278, Computation and Assessment of Miscellaneous Penalties, will be completed and used for assessment unless the penalty is related to a joint return. The Non-Master File Assessment Voucher, Form 5734, will be used for the joint assessment of the penalty. See IRM Part 5.1.1, Collection for further information. </BLOCKQUOTE>

Again, we draft the disclosure office & request those documents.

Remember, request docs, don't ask for laws, authorities. Request employee id#'s, the name of the employee who filed the docs, a copy of their job description. We need to prove breach of duty & lack of authority or sepping outside the bounds of it.
