ucc-3 computer entry....

a friend is dealing with lien on gov. annuity pension. i shared the info with him from a sui juris post on the ucc-11 and ucc-3 process.
he sent me this email this morning :
"I am ready to make a visit to the Bath County, Virginia courthouse. I read and re-read John C.: Stuart’s “tips-and-tricks” email and the “Tax Truth Newsletter” on UCC-11 and UCC-3 to remove the Notice of federal tax lien. I had previously completed a UCC-11 and got a “no liens recorded” from the Sec. of State, so all I needed was the UCC-3.
I went to the court house and everything was going fine until the clerk got to item 9 on the UCC3. Item 9 wants the name of the debtor. I am not a debtor so I told her she could not put my name there. The computer software would not let her go any further and complete the recording of the document. My next step is to call the Secretary of State office and see what I can get done."

Line 9 0f the UCC3 is "NAME OF SECURED PARTY," and a box to check if the form is for a debtor terminating.

Is he a secured party or a debtor?

That line has to be filled out or the form cannot be filed.

Do not check the box.

On line 10, type in "Secured Party:" on the RIGHT hand side of the line, leaving enough space for the secured party signature.

Is he certain he fully comprehends what is happening with UCC filings?

understand filing

he may but i have not gotten into that area so i don't. when someone asks a pointed question, i have found they have some important tip, piece of wisdom, or pitfall to watch out.
i would appreciate it if you can [if its possible] explain it for me or can you direct me to a forum link or web site to explain your note of caution.

Your friend stated he was not a debtor.

Fill out the line 9 Upper-Lower Case name, do not check the debtor box, and sign, either as I suggested or otherwise.

I suggest he sign in blue ink on the right hand side of the signature line.

Get the filing done.

They should take it.

Be nice to them.

The clerk was doing your friend a favor by pointing out the incompleteness of the form.
