You were right after all.
The stuff I was thinking about was found in the Great IRS Hoax file on the family gaurdian.
IRS Hoax Document to Download
In section 5.5.9 page 1069, it lists the specific rulling about the IRS filling out a form for you.
I know this is Federal, but it would be a good place to start I would think.
Maybe look up the duties and limitations of the State Secretary of Treasury.

Unfortunately, Chris Hanson has broken up the original IRSHoax document into two parts: information and strategy. He now charges for the strategy part. Only the information part is available for free download.
I spoke with SuiJuris about uploading the last version I have (late summer, 2003) that has both together, but he suggested asking Chris about it first. I've emailed Chris Hanson's email address before and I did so again about this. I've never heard back from him.
I would love to upload this here, if possible.

[color=black][b]Wirlwind, if you haven't already, got to the ANNOTATED statutes for your state & ANNOTATED federal to get some case law into the record. Try to use Supreme Court decisions
I believe the SFR stuff is 26USC6020(b). Check out the USC26 dealing w/ Willful failure to file in the ANNOTATED stautes. I'm not sure how to do this, but you need to get all of your facts & law filed into the record for it to count

If you read my initial post on this thread, I cited a code under the Alabama Taxpayers bill of rights that says that they clearly were over the amount of time that can be given, even if they request additional time- which they didn't. that was what I was going to use when requesting a default judgement. Do I really have to use all this other stuff? I might if I don't get the default judgement.

My thinking is that the Taxpayer's Bill of Rights only applies to taxpayers. If you use the Taxpayer's Bill of Rights to support your position, aren't you saying that you are a taxpayer?
Is there a contract in force between you and the STATE REVENUE OFFICE?
The only way they can compel performance i.e. file a form, is via contractual nexus. With no contract in force, they can not compel anything.
If you use the Taxpayer's Bill of Rights, you are allowing the presumption that a contract is in force and that you are not Sui Juris with respect the ADR.

You are probably right, but I don't know what else to do. I thought about that. However, arguing your being a taxpayer doesn't seem to work. They didn't ever answer whether they were going to accept my CPN or not. If I end up going to court, I was going to present another one in front of the judge and court reporter.
Any other ideas?
