Talking Got a response!

Check this,

I actually (finally) got a letter from the Transport Minister.

Dear Mr.......

I refer to the documents "Notification of Journeying in Peace" and "Notice of Agreement by Mutual Consent" forwarded to my office on ...........2006.

In response to the matters raised by you I confirm the right to drive on ......................... roads is vested in all citizens provided they comply with the laws of the State relating with the use of motor vehicles under the Road Traffic Act and the Motor Vehicles Act.

Both State and Federal laws permit a citizen to travel throughout ............................ without restriction provided that right is exercised in accordance with law and in consideration of the safety of others.

I trust you will have many enjoyable and safe motoring days ahead.

Yours Sincerely

Minister for disinformation

My reply..

Dear .............

Thankyou for your letter dated .....................which confirms that you have indeed received, read and are cognizant of the agreement between us.

In response, I shall keep in mind the matters raised by you in relation to "citizens" who may be "driving" commercial "motor vehicles" and agree that those statutory laws would apply in that situation.

In my correct capacity as beneficiary of the original Jurisdiction I intend however to continue journeying in my private automobile, in peace, unrestricted, and with all consideration for the safety of others, on the common ways of the land, exercising my god given rights, waiving none ever.

As I have the consent of my wife, and we have mutually agreed, and being responsible for our own actions, she and our infant son, who is in our care may from time to time journey with me, also enjoying their god given rights, waiving none ever.

We shall indeed enjoy many safe journeys on the land mass known as.............and hope that you may too.

Thankyou once again for your time.

Excellent response. I note that you did not take up the mantel of argument and attempt to point out the truth of the law in rebuttal to his attempt to pull you into the jurisdiction of the corporate "policy".

Good job.

But they only have to obey laws related to "use" of the motor vehicle. Look at using here...

To enjoy the car is totally different.

As I'm trying really hard to learn here, that word MAY just doesn't sit right, it's almost presumptive of permissiveness. Wouldn't a statement such as WILL be better. As in, they WILL be...? Just wondering.

Also, why did you add "who is in our care?". You've aleady established he is YOUR son.

These word games seem dangerous to me. The less of them you use, the better off you are...IMHO as a newbie!

Would you say that his wife "MUST" travel from time to time???

Ha ha! Considering I am actually considering your response is telling of the fact that I try to be mindful of my words.

In all honesty though, MUST/SHALL/MAY are legal words I am not clear on the ramifications of.

SHALL and MAY are used extensively in statute.

Apparently our Governor General MAY make provisions in many of our statutes (Canadians) but that always leaves me wondering if she has!

Can you help clarify?

Hey there..

Good points all, the reason for using "may" was purely to make it her perogitive and desicion as to when and if she comes with me, and implying to the powers that be that it is my/our permission to do so within the construct of the agreement with the minister.

BTW, just got another letter from his assistant today:

Believe it or not they are using my proper name!!!

Even the hyphen etc..no more all caps for me.

Dear Mr ............

On Behalf of the minister for Transport, the Hon ......................MP, I acknowledge receipt of your letter dated .....November 2006.

Your correspondence will be brought to the attention of the Minister.

Yours Sincerely
Assistant

Thanks BPM

I am curious, is the minister responding to your original Proof of Claim? If so, was response done in a timely manner?

I was under the impression that you already had your agreement in place. If this is so, why would minister suddenly write you?

Just trying to clarify, in my mind, what stage you're at.

As a complete aside, many years ago I sub-contracted for a while working at one of our deputy-minister's office.

All written communication was taken very earnestly and date stamped when rec'd. Action had to be taken immediately, and response had to be within a certain number of days....(think it was three! haha!).

I remember at the time, being very impressed with the seriousness taken of receiving communication.

It seems something has drastically changed now. Last time I wrote our PM I didn't even get a response.....hmmm.

Is the machine so self ignorant now or are we further down the road to complete tyranny than we're aware of?
