What to say to a police officer when "pulled over" for

The variables are numerous. Anything can happen.



One strategy is to lock your doors and just crack you window so that you can hear each other. You can slip through the window some enlightening documentation of your choice for the officer to read and understand you rights of traveling in your property.



Commonsense should cue you as to the necessity to modify or supplement this strategy ( i.e., if the cop threatens to kill or harm you or your property). Then you go along with the cop acting under duress, which should make getting out the ticket easier. It would be nice to have a tape recorder on to document how the events transpire.

This is from Howard Griswald's material.



When pulled over....



Never give your name. When he asks for a driver's license, reg, P.O.I., your name, You simply agree....



You say, "Yes, of course Officer, as soon as you give me":



1. Your name

2. The number of your bond

3. The name and address of your Bonding Company or

4. The name and office address of the Risk Management Office which handles your bond, - Then I will give you the information that you request."



I have also read about people just going ahead and getting the ticket but then filing an Affidavit of Corporate Denial at court. The case, supposedly, would be dropped. That would be a different topic for another thread though.

Officer; let me see DL,REG ....

You ; sorry I can't help you.



Other than that the only thing that is required is to give your name.

Officer, am I under arrest?

No? Good. I'll be going then.

So, I cannot go? Then I must be under arrest. May I see the warrant in your possession with my name on it?

Is it in your car?

Then, let me understand, you are arresting me with no warrant let alone a warrant without my name on it?

Tell you what, I am going to record this so that if and when I need to bring suit to you personally for depriving me of my right to travel, being secure in my papers, free from search and seizure, prohibiting my exercise of free speech because I cannot travel to my destination, possibly depriving me of my property, and anything else that may come up in the next few minutes, it will be very easy for a judge to render a decision.

And you are doing this all under the color of law?

This successful win may take a few months, but I am quite eager to show the public how you are depriving me of certain unalienable rights. Court cases have supported with handsome monetary damages those whose rights have been ignored or abused. Do you have a boat?



No, I haven't used it yet, but I go over it in my head when I am driving.

NOTICE TO ARRESTING OFFICER WITH MIRANDA WARNING



NOTICE IS HEREBY GIVEN: The individual you have placed under arrest and have in your custody is working in the capacity of a Civil Rights Investigator. He/She demands all their rights at all times and does not waive any of their rights, including the right to personal time and property at any time.

You are hereby Noticed and Warned that from the time you detained me your actions have been scrutinized. Every illegal and/or unlawful action you take will be documented for civil and criminal prosecution forthcoming under USC Title 18, Title 28, and Title 42, 1983. This NOTICE is made in good faith.

AS TO CRIMINAL PROSECUTIONS: After you have given your name, badge number, rank and proof of agency, you will have the right to remain silent. Anything you say from that point forward can and will be used against you in the form of criminal affidavits and civil sanctions. You have the right to counsel present during any interrogations or civil disclosure.

DEMANDS TO BE MET BY ARRESTING OFFICER TO AVOID CIVIL AND CRIMINAL PENALTIES

1. Warrant-less Arrest: You are not to arrest me unless you have seen me commit an arrestable act or omission, or have exigent circumstances to cause the arrest. If you are arresting me without a warrant, you must IMMEDIATELY take me before a judicial officer of competent jurisdiction, to determine whether the arrest was lawful, or if there was probable cause for the arrest, pursuant to clearly established law. This demand must be met prior to booking. If you do not comply with this Demand you will be sued. The Supreme Court has held that the courts are open twenty-four hours a day, seven days a week, three hundred sixty five days a year.

2. If you improperly arrest me without a warrant in your possession, or with a warrant that does not comply with The Fourth Amendment requirements, you will be sued in your INDIVIDUAL capacity. 3. Arrest Upon Warrant: the arrest warrant must be in your possession. An affidavit and probable cause statement attached to the warrant as subscribed in The Fourth Amendment to The Constitution for the united States of America must support it. The arrest shall not be based upon hearsay, unless supported by a warrant accompanied by a bona fide affidavit. Said warrant and affidavit must be based upon first-hand knowledge of the Affiant charging me with a felony or other infamous crime. I must be allowed the right to face my accuser. If you deny me that right it will be a violation of The Sixth Amendment, and if you act unreasonably in your investigation or use excessive force, it will be a violation of The Fourth Amendment, both of which violate established law.

4. If it is determined later that the warrant was invalid, you will be held liable for false arrest and sued in your OFFICIAL capacity.

5. You may not take any of my property or wrongfully convert any of my property, such as my personal photograph or my fingerprints without written authority. Such is granted only after an adversary proceeding which complies completely with The Fifth and The Fourteenth Amendment due process rights, concluded with a signed order by a judicial officer of competent jurisdiction ordering the taking of said property.

6. I must be given a phone call forthwith to contact my outside counsel or friend.

7. I must be given pencil, paper and adequate access to a law library, to prepare my "habeas corpus."

IF YOU IGNORE THESE WARNINGS, it will show bad faith on your part and prima facie evidence of your deliberate indifference to Constitutionally mandated rights. A copy of this instrument will be prima facie evidence of your bad faith. You are a Public Servant, and as such you are expected to treat me with due respect.

This NOTICE has been submitted upon demand of a ‘drivers license,’ ‘registration,’ ‘proof of insurance,’ or any other State issued privilege, permit or license and therefore is a mandatory part of the official record of any ensuing action and MUST be introduced as prima facie evidence in said action.

It will be noted that willful suppression of evidence is a felony. Any cause for action will result in a lawsuit under USC Title 18, Title 28, and Title 42, 1983.

[color=black][b]Thanks, Akira - I've been looking for something just like that. However, I am wondering as to the timing of submitting the document. I have been pulled over many times & kept my cool with my hands on the steering wheel so the cop can see them & Rolled down the window upon his command so that he doesn't think I am reaching for a gun. As a result, I have not gotten a ticket the past 3 times I have been pulled over. I am not going to deceive myself, though. Another factor could be that I am not a minority & therefore not being racially profiled.

So should we whip out the document from the get go & get the cop on the defensive or wait to see what they do when they come back to our car? I am leaning more towards drafting them with the documents if they issue us a ticket when they come back.

I've been arrested twice already. As far as i know there is no statute of limitations on false arrest so as soon as my knowledge gets to the point where I feel comfortable taking those b*stards on in court, I'm goin after 'em!

When to use it? Well... it is called "NOTICE TO ARRESTING OFFICER" perhaps there is a clue, as to timing, there.. lol

I, too have been falsely arrested twice...

I regret, I have been unable to pursue, not because of a lack of opportunity, or ability, or understanding, or intestinal fortitude, or even time, but because of a lack of MONEY.



I really need to come clean about all of this...



I had them 'right in my sights', but let them go because I just don't have the filing fees... (very upset with myself about this)



I will be posting the situation that began my quest for knowledge, in due time...

Defintely choose your battles wisely. You don't want to have too many feet in the fire at once.



At one time, I was going to try the debt elimination, but since I'm now doing the dance with the taxman, I don't want to be fighting on two fronts. Maybe I'll tackle the CC's after I spank the taxcollectors and send them home crying
