I had cited elsewhere on this forum an ALR article on the criminal aspects of refusing or failing to show a policeman one's DL. Since the policeman has no evidence that you are fit to drive and now is probably curious about whether you are concealing your identity, you can expect to be detained. Arrested might be too strong a word, but the cops will probably make you wait until proof of your identity comes in. Unless some family member shows up promptly with something persuasive, like your passport or real DL, don't be surprised if the cops do this at a snail's pace. Even if you are identified, if you can't prove you have a valid current DL, they might not let you drive yourself away.

I have heard that in California, the cops carry a stamp pad and make any driver without his DL put his thumbprint on the stub of the traffic ticket; that way if he doesn't show up in court they've got something to work with to bring him in. I don't know if California is satisfied with this experiment or if other states will try the same.

In any case, the outcome will not be convenient to you.

And the McLaughlin decision did uphold the reasonableness of a 36-hour maximum between arrest and arraignment. If someone's as rude to the cop as I've seen suggested on other threads, they'll get a chance to see how quickly a full 36 hours can creep by.

And again you use diversionary tactics to avoid addressing the crux of the matter that you were wrong. No matter, it's a good illustration to new readers of the manner in which you attempt to avoid and obfuscate issues when directly challenged.

I have done that more than once. It is no fun but effective.

P.S. Get a certificate of search on your true name (First Middle), in upper and lower case letters, from the clerk of court at the US district court where you live. File that at your county clerk and recorder and give that to the police officer to identify yourself.

And under which laws of which state is your homebrew DL issued??

You don't seem to realize that simply telling the cop who stops you, "Gee, I left my wallet in my other pants" or some other common (if phony) excuse, or even leveling with him that you don't have a (current, valid) DL, will probably cause you less trouble in the long run than handing him a homebrew DL which proves that you went to what must have been some effort to pull a jennabush on him, as well as insulting his (limited) intelligence by suggesting he'd fall for this fake license, etc.

Not having a license with you is one thing. Working up a fake license is something else and it will excite his curiosity as to who you really are and why you aren't showing him a real DL, enough for him to pull you in.

I realize that SFBFKADVP is used to spending time behind bars and doesn't mind. Some other readers of this thread may have other hopes and plans for how to pass the time.

Nope. I learned my lesson. It just took spending some time in holding cells instead of conforming to get the lesson down right.

What it says though, a college trained law librarian with a license to practice law resorting to that kind of slur, is that it really gets to you Shoonra. Thanks for that intelligence.

All I suggested was that you give a Certificate of Search on your true name to the police officer for identification purposes - that you tell the truth in fact. And you let him know since that is not your name on the Driver License card you are only handing that so he or she knows you passed the competency test for operating heavy machinery on the roadways - motor vehicles.

And that brings up AndyK's nickname/acronym. AndyK is a Treasury agent by the way...

My homebrew license is issued under the laws of my homebrew state of residence. I hold a valid permit therein.

Do you know better? I also hold a valid permit in Nicaragua. In Central America, the answer to "where's your license?" is: "ees onna back a da cahr, man"

By definition a homebrew is made under my own roof of dwelling. Good homebrewed ale, stout and pilsner.

Let's all meet in jail. There's plenty to learn in there as well. You can quit smoking, for example, and get in shape.

How about 5 million young single people with a bit of free time on their hands all volunteer for a bit of 'jail duty'? Get a "hoop-dy-hoop" car for 100 bux and drive around 'waving your freak-flag high'.

Never mind. Get an attorney instead and do exactly as it says. The answer is no, and can't, and you'll be sorry. And "Where's my fee?"

LOL - Add a little music and a cash bar and you've got a good party. Unfortunately, you'd probably be asked to leave early due to the overcrowding problems.
