Its not that "it's transportation because its cargo"- problem there is then you get lost on "but its not cargo, its private un-consigned property!" Which is irrelevant to the definition

Its cargo because it is or may be transported.

The important thing here is to keep track of the object, and the subject, in the phrase.

If the "persons or property" are the subject of the device (the object) then its vehicular traffic.

If the the persons or property are the object, and the travel apparatus is the subject, then its mere private transit.
