State Motor Vehicle Codes

Guys, please post links to your state's chapter on drivers licenses within the Motor Vehicle Title of your state statutes. In other words DO NOT just provide a link to the whole face of the table of contents of the entire state code. Provide a direct link exclusively to the chapter of the MV code dealing with the drivers license statutes

Hmmm. I'm seeing that the Act is from 1949. The key is to go to the law library and look up the legislative session. The best stuff for DL's is in the Legislative Acts from the 30's. They all state unequivocally that it only applies to those engaged in commerce and not to those in a private capacity. Also, most of them have yet to be repealed, so they are still Law, although not stated inthe code

Weis,

The 1949 Act repealed Act 302 of 1915.....So the 1949 Act with its amendments is the controlling law.

You need to really look this stuff up at a law library, some things are not what they appear to be. I was amazed when i put my hand to the books and physically photocopied the acts. One must read closely

Photocopy the actual 1915 to 1949 acts themselves from the leg sessions. Alot of what is repealed is not the substantive law, but just the dept overseeing.
Or it will say anything contrary to it is repealed, so if they do not mention non-comm driving in 1949, but clearly said that it doesn't apply to non-comm, then it still applies because non-comm isn't even included in the 1949, just who is overseeing it and with a few extra tweaks in the definitions or new codes, but not mentioning non-comm IN ANY ACT

See, this is the LAW:

RSMo 1939 § 8443, A. 1949 S.B. 1111, A.L. 1951 p. 678, A.L. 1955 p. 621, A.L. 1961 p. 487, A.L. 1978 H.B. 1634, A.L. 1980 H.B. 995 & 1051, A.L. 1983 S.B. 44 & 45, A.L. 1984 H.B. 1575 Revision, A.L. 1986 S.B. 707, A.L. 1987 S.B. 114 merged with H.B. 384 Revision, A.L. 1988 H.B. 990, A.L. 1989 1st Ex. Sess. H.B. 3, A.L. 1991 H.B. 251, A.L. 1995 H.B. 717 merged with S.B. 24, A.L. 1996 H.B. 1169 & 1271 merged with S.B. 722, A.L. 2002 H.B. 2062)

The earliest says it's 1939, but you can go earlier than that. You go to the leg session books for like 1930 on up and look in the index in back under motor vehicles or drivers licenses and it will point you to those sessions which most likely say it does not apply to non-comm, just for hire. The subsequent acts will state words to the effect of "anything contrary to this is repealed"; yet the new act(s) never bring up non-comm driving in the first place, so it will be proof that the older acts were always intended to apply just to comm.

That can still be tracked today by going through the Revised Statute definitions but applying generic law dictionary definitions of common carrier and commercial carrier. In the Colorado Revised Statutes that is distinguishable by two definitions - vehicle and motor vehicle. There is only one reason for having a definition of each - they are different things!
