suijuris.net is one of the very few sites&that you will find "free" stuff.& suijuris.net is completely without cost to users. suijuris.net has as its goal to inform and educate as many as possible in the hopes of steering this great nation back to that course envisioned by its founders, to take it back from those that have stolen it.

Anyone that wishes to share that which they have learned is welcome to do so.& BUT there is no obligation for anyone to participate in this way.& It is always good that members can point the way for others to find the tools they need through their own diligent efforts.

Thanks for your recommendation. Like the other members stated, suijuris is intended to be a resource where people can find FREE resources and help. So, whenever possible, please share any specific tactics you have learned, as you will find that the other members at suijuris will do the same when possible.

But it is also&OK to share where you learned your tactis, (as you have) so others have the option to learn in that manner if they so choose.

Keep the good stuff coming!

If so, there are no absolutes, and the only logical conclusion is that reality, truth, and right and wrong are determined arbitrarily on a daily basis by those with the most power, guns, and money, and the rest of us can choose to run, fight, or be their slaves.

Re:Police towed my car

Hi All!!

I took some time to rest up for the long haul.

I went to the court to find out what the outcome of the judge's ruling was. They didn't have anything in the computer, and the file was on the judge's desk, couldn't access. The judge took it upon himself to enter a plea of not guilty for me, I wanted to see how he arrived at that plea. I've been told that he had no authority to do that and that he was "practicing law from the bench".

The clerk at the courthouse said that she believed that the impound of my car was a separate issue that should have been documented with it's own citation. I never rec'd anything, just a business card from the tow company. I'm on the hunt for the particulars on their right to impound. I remember hearing something about a concept called "due process", but I'm not sure if it exists anymore.

Thank you Andy Jackson for the recommendation. We already have an "Andy (c)", so I'm assuming you're a new guy? Welcome!

Re:Police towed my car

This looks like a success... even though you have not yet been completely satisfied.& But, since you were found "not guilty" and your car was impounded, and you have been put through so much inconvenience... it's time for an action in court... one that you file and name your damages.

At least, that's my take on it.& If the judge couldn't have been nice enough to complete the "not guilty" verdict by returning your property to you... then take it a step further and see if you can't get a few extra bucks out the whole mess.& Charge them for your time (at least $45.00 an hour) and inconvenience (not having a vehicle, any cab fares, damage from missed appointments due to lack of wheels, etc. -- really tack some stuff in there!!).

But, maybe some other members would have other opinions/suggestions/insights.

But like I said, you got a victory already!!& Good Job!!

Re:Police towed my car

Flunky,

Looks like the charges have been successfully reversed, great job!

I agree with Ice, they have caused you a great deal of injury and loss of time. And since they have not returned your property, it is your turn to use the court against them.

My time is worth far more (to me anyway) than $45.00, it is priceless - particuarly in an event such as yours. And of course there is damages as well...

Good luck, hope you can collect your property, some $$$ for damages, and put the city in chapter 11.

Re:Police towed my car

Ice- you mentioned missed appointments, how does one put a $ value on a missed appointment?
What's the embarrassment and humiliation worth?
Walking didn't cost me any "money" but it cost me my time and energy, can I bill them for&worn-out shoes?
All of my replacement transportation was "paid" for with either a check or CC, just in case I needed to recover the expenses. If I had more money to work with I would've spun the damages meter, and never been a day without transportation.
As to the $45.00 per hour, I'll bet I've put in 60-70 hours on reseaching this issue, but I don't think they'll believe it. I've spent at least that much time explaining to others how the officer had no right to be what he did. And twice that much time explaining to myself that I'm doing the right thing.
The "Notice and Demand" is required to exhuast my administrative remedy, which I'm hoping they will honor. If not, My damages will continue adding up and it will give me more time to come up with more charges against them. If we're going to court I'm taking no prisoners.

Thanks to all for your support!& FNM

Re:Police towed my car

First, try this:& Present the Order that "released the defendant" (the automobile!) to the holder of the auto.& If they refuse to release the auto to you -- then it is time to file.

As for the $$ -- I would charge $45.00 for every hour spent walking, typing up docs related to the action,&ect.& And&think about this:& attorney's charge (on average) $90.00 an hour for consultation... you can set your own hourly wage.(I&try to keep my fees reasonable... but that's me).& Then there is the damage to the shoes, not to mention the emotional and mental strain this ordeal has put you under.& And you have gone through all of this because a so-called "officer" does not know the law.& You can charge $$ for anything you can think of... pile it on!& Estimate the amount of time it took to type up the docs like this:... hmmm, I "hunt and peck"... so it took me HOURS to do just one document.& Get the idea?
