Traffic Ticket

I was pulled over by highway patrol last night for having a broken seat belt.

He asked me for my DL , Registration, proof of Insurance. I gave him my DL , but I couldn't find my registration or insurance papers. He gave me a ticket for the broken seat belt, no registration or insurance papers. All of these so called "violations" are correctable but he marked on the ticket that all three were NON-CORRECTABLE!!! I couldn't believe it. I believe he did this because I got out of my car and argued with him about the seatbelt and registration card. While I was talking to him I also called him a jerk. He gave me ticket to sign and I put a large X in the space and he asked to see my drivers license again to compare the signatures. I grabbed the ticket from him and scribbled my name all over the ticket. He then got on his motor cycle and left.

These violations are going to cost me a couple of dimes and nickles being that they are not correctable. How do I handle this. The no insurance is going to cost me in the range of $750!!! I have insurance!!! and I have a registration card. I just didn't have it with me.

Any suggestions?

when you go to the chambers of commerce (court) with you're insurance card and registration and it is up to date they will dismiss the charges, but you will get stuck with the no seat belt, after all they have to steal something from ya.

The problem is, THERE IS NO COURT! There is no court date on infractions - Moving violations have court dates. With infractions, its Trial by Declaration ie., in writing only!

On the back of the ticket it says if the "Yes" box is checked on the front of the ticket, then the violation is correctable. If the "no" box is checked the violation is not correctable. !!

I suggest you do the trial by declaration.

What state is this?

Thanks BT, but it is not going to make one bit of difference if it is in writing. Your chances of winning a Trial By Dec. is less than court, unless it is blaringly obvious the cop was wrong.

I'm going to call the court about the registration and insurance. It doesn't seem right at all - I didn't know cops had that kind of decision making power-- Something that is obviously correctable, but because the cop doesn't like you, it isn't correctable. Unbelievable.

Know who you are. Right now you feel you are a victim, and you are to some extent, but WHO you are is much higher than a being a victim. You are a sovereign creation of God who has inalienable rights NOT given to you by "the State." Further you are a law abiding kinda guy who has insurance and all those magic papers for your own reasons.
The cop knows who he is because of the gun he carries. You calling him a jerk didn't help things.
Unfortunately for the "State" your living in, they have now converted a "good citizen" into an enemy.
Trial by declaration? Is that really a trial or just an oxymoron? With ZERO due process, not even a hint of the charade of traffic court, I don't see how your ticket holds water. Where ever you mail your money you need to go to speak with someone.
Ask her if their office upholds the Constitution. Are you entitled to know the nature and cause of these charges? (Nature means if it is civil or criminal). You need to start somewhere and stewing about it will keep you where they want you.

Trust me, I know who I am, but... it don't matter who you are when you have a DL's, registration and insurance. Your papers please.

If I don't pay, my DL will be suspended. More fees added to get it reinstated. If I drive on a suspended license I could get three days in jail. I'm not afraid of going to jail, because I did nothing wrong but fail to pay a ticket on a broken seatbelt and not having my doggie papers with me!

I don't know what I'll decide to do. Depending on the amount of FRNs they want, I might cancel all my papers and join the Indian Nation!

Why don't you check the "State" statutes and see if what the cop did really applies?
