Insurance Blues

HELLO to all, this is my first post. I've been reading for some time now. Well, to get to the story. First of all this is in Michigan, where we have NO FAULT insurance (if you have it). Anyway, I was at a gas station putting air into my tires, where I was blocking a guy in, so I pulled forward to let him out and then as I was backing up to the air pump some lady came flying into the spot and we collided. Anyway, she calls the cops to file an accident report, and he comes and does his thing. Asks for licence and registration. I give him those which I do have, but no insurance (don't have). anyway, he comes back with an accident report number and says here it is if you need it. So PRAISE GOD, no fine, ticket, jail, or that matter. Well, I thought the thing was all over. Nope, got a letter in the mail from her insurance agency saying they are working on a claim for her deductible and wants my insurance info. Respond within 14 days or they will assume I didn't have insurance and will be trying to collect for not only deductible but all damage. Anybody, can you suggest what I should do here? Can they do that to me? What's the deal? RSVP please, time is running out.

something to consider

If you had all your ducks in a row regarding the travel issue you could possibly deflect their threats. But since you don't your ammunition is limited. I'm no expert at no fault insurance but it seems to me that it is a sneaky manuever on the part of the insurance cos. to avoid having to deal with the hassles involved with fault,lawsuits,proof, etc., etc. And in the end both of you will have your rates raised accordingly. How much do you estimate the damage to her car to be? Find out what her deductible is. If the damage is relatively minor and the deductible is not outrageous offer to pay what you can afford. Also I would assume that Michigan has mandatory insurance laws, but the fact that you weren't ticketed implies that those laws can't be enforced on private property. So now the no fault laws don't apply and it becomes a tort. Who was at fault and to what degree? Do you have any witnesses, photos of the scene and damage. You may be in a stronger position than you originally thought.

YOu definitely need to respond, because it seems like it is a self executing contract to self destruct in 2 weeks.

Think about this.

Was the letter signed?

If not, who sent you this?

Put it in writing that Your information is private and you do not wish to disclose this info.

Mention that you are not an attorney and you don't understand insurance law and that you need to see which
1.principle,
2.facts,
3.law, and
4.mthods of consideration

are being followed which would allow them to pursue collecting on damages on top of dductible for you not producing info.

Put the requests w/numbered paragraphs and a clause stating that if they don't respond in 14 days, then they admit that their original request for production is NOT based on law, facts, principle, or consideration.

In theory, you want to prove arbitrary & capricious behavior

Signed Letter?

what does it matter if the letter was signed? She's working for the corp. ins. agency and they have a nice letterhead with Nationwide Insurance right on it. Anyhow, I looked a little at Mich. Ins. laws and it seems they can get me for her deductible. They claim I'm at fault through there investigation...How do they assume that? What would I do to contest the at fault part of all this. I don't think I'm totally at fault... if they are trying to collect for this, what recourse do I have for the damages incurred to my vehicle? I got a copy of the accident report, and the officer states something like "neither one of them saw it coming" Should I put something else in the letter regarding that piece of it? And how do you mean numbered paragraphs? Insurance.....what a joke.........God Is my assurance, who needs insurance? I'd like to include the scripture verse "For the love of money is the root of all sorts of evil" Anyway, thanks in advance, I love the fact that so many brothers come to the aid in helping fight against this corrupt world system.... Even so, come Lord JESUS.
