Not one offer for remedy. When situations like these arise are we not to give remedy? I found nothing but sarcasism and teasing in something that is real and violates our rights. Constructive info would be helpful.

In North Cacalacky statutes, it states that the oficer must observe you in a forward motion without the seat belt securely fastened.

This, he cannot do, unless he can see both parts of the latch.

Probably no one meant to demean you or tease about this, and probably no one has constructive info about what to do about it either.

I do not know what to do about the police state we seem to live in.

They have guns, and they have orders.

Maybe sometimes you have to laugh just to keep from crying.

The only info I found that might help you is this.....in Missouri, the sheriff, cop, and prosecutor retirement funds are inured from fines. In conjunction with TS docs that might get it dismissed. It would really be great if you find a smoking gun doc stating the JUDGE'S retirement fund was inured by fines! They dismissed my stop sign ticket because of that. I filed the doc with my initial affidavit and had the court take judicial notice of Tumey v Ohio which basically states that uopn timey notice the defendant has a right to an impartial judge and has the right to stop the trial, seeing that the judge receives funds from the outcome and seeks to generate revenue for the municipality. This was a prohibition era case and Mr Tumey was tried by a mayor's court in Ohio and fined 100 dollars. The mayor received 10 dollars as his payment for "judicial service" rendered. Chief Justice Taft's opinion waxed rather eloquent!

Before Sui Juris joined with Law Research Group, a member posted free remedies. One of those free remedies were on the seatbelt issue. Anyone remember this?

Just tell them you are not in commerce, you are traveling in your private capacity, and they have no authority to regulate living souls.

If they seem to believe you are in commerce then take that cop to task and make him prove you were engaged in commerce.

Maybe something like:

Officer: I stopped you because you are not wearing a seatbelt.The law says EVERYBODY must wear a seat belt.

YOU: Oh I agree officer, everyone who is involved in commerce on the streets and highways for capital gain better be wearing a seatbelt, however I am taking care of personal business now, so it is not required of me.

I will admit that this is probably easier to accompolish if your auto is not registered.

I sense that discrimination against those living in that apartment complex might be a good issue.

How many other complexes received tickets that day?

Did they ticket on private property or off private property?

Did you get a ticket? Was there a way that receiving the ticket, if living in that complex, could have been avoided? Perhaps forenoticing the event and going somewhere else for a while.

Mere seat belt violations are good tickets to receive to get practice on raising issues, because there is no threat of jail time.

I suppose the major question is- What do you want to do about it?

This is a housing subdivision and not an apartment complex. The police officer was blocking the entrance of the subdivision, so that one had to stop to enter. At that time the office would ticket the man/woman. Most of these men/women were young.

I was looking for the individual who posted the free docs on Sui Juris before the blending with Law Research Group. This person was bringing LIGHT to the DARKNESS for free. I don't seem to be able to find that posting. It would be greatly appreciated if someone would lead me to that link (if it still exists) so that I can PM that man/woman. Thanks!
