Post Speeding ticket? Didn’t make me sign? A possible easy win?

On my way to work this morning i was detained by an "officer of the law" and accused of breaking two RCW's (speeding and driving with out insurance)

I started by saying good morning, he asked for ID and I provided my "license to drive" that contained my signature and "without prejudice" above it.

He came back with a nice green piece of paper (the ticket), handed it to me and asked if I had any questions.

I asked for his card, he pointed to the ticket and said it had all I needed.

He left and I pulled back into "traffic".

The hitch? Instead of asking for my autograph he wrote "given to above person" in the spot normally signed by the victim.

What do you guys think? Is it void where it stands or am I going to have to peruse a ticket slayer type counter assault?

On top of that he Put the wrong date on the ticket!!! (yesterdays date)

Was he just giving me several reasons to fight this or what?

IT ALL DEPENDS ON YOUR STATE.

I would use ticket slayer. A person does not need to normal sign a complaint from the opposing party. They just have to have it served on them. It was served on you.

The prommis you sign is just so that they can slap an additional charge on you and collect even more if they have to find you.

Other than that in my state if they serve you with a ticket and you do not defeat it in some way, they will issue a default civil judgment against you.

This is in Washington, Pierce County.

On the ticket is states
"WITHOUT ADMITTING TO HAVING COMMITED EACH OF THE ABOVE OFFENCES, BY SIGNING THIS DOCUMENT I ACKNOWLEDGE RECEIPT OF THIS NOTICE OF INFRACTION AND PROMISE TO RESPOND AS DIRECTED ON THIS NOTICE"


And above the line He wrote "given to above person"
and there is no signature.

Not likely. These revenue collections agents are only after your money and nearly every citizen in recent history has allowed these agents the privilege of consistently ignoring the law in their attempted dealings with you OR your strawman. This 'ticket' will end up on the District Attorneys desk as a prosecutable item based on the court 'officer's' testimony and then they will wait for your argument or plea at the administrative arraignment in order to establish confict and jurisdiction, then they will railroad you and collect your sweat equity. Either that, or they will issue a bench warrant for your arrest if you do not appear and pick you up while you are eating evening supper.

If you desire to fight this thing from the beginning, there is a TON of info on this in these forums. Grab some coffee or tea or redbull and start reading. I would challenge jurisdiction, then demand a verified complaint and damaged party and then demand to review the evidence, (which they never have). You may want to check out ticketslayers process. There are many methods and opinions that are ALL here.

Good luck and remember: the agents of this system have very little knowledge of the unlawfullness of their actions. "Forgive them, for they know not what they do".

I have been lurking this forum going on a year now and have a fairly good concept of what you are saying.


I was just considering taking this head on in there realm using the fact that the ticket is all screwy to just get it over with quickly and painlessly.


I think maybe he was giving the court a way out after seeing "without prejudice".

You gave the strawman ID, and he wrote the ticket to the strawman... he didn't ask for the signature, because he knew you would likely put 'without prejudice" and so he removed the opportunity for you to do so. Presumption, presumption, presumption.... So far, in the judge's eyes, the contract is good, and you have the burden of proof, all because you accepted the ticket.

The judiciary is rising to the occassion, altering their game plan, devising new stategies, and setting up new traps, all based on presumption.. they're taking away our opportunities to challenge / rebutt... the steamroller approach.

They're out of the closet, denying due process, and going criminal. You can expect more of the same in court..

The TS docs, are a step in the right direction..

A registered novation to the state, ect. stating you only have the license as a matter of convenience (poorly trained LEO's), and travel as a matter of right, rather than priviledge, is likely to become a necessity, for all licensed travelers.

Insruance was under 116.30.020 I think, its very hard to read his writing.

116.61.0400 for "speeding" as far as i can tell.

After looking the related RCWs up its 46.61.400 for speeding and 46.30.020 for insurance
