#1. do you mean speically not specifically.
#2. exactly what is "crap" about ucc? i have used different sections of the ucc with sucess in court. how much do you study the ucc? which verison do u own?
#3. are you under the constition? what have you done to return their license etc.? if nothing then you have made an agreement of some kind which comes between you and the constition.
#4. if you have an ssn, they have territorial jurisdiction.(you could still win the case, but you must look at it differently to do so.)
#5. do you study the traffic statutes in your city/state?
#6 . as to the "they came on my property..." its called hot pursuit which means if you had ran into the house they could have followed you in and took you out of your house.
#7. your not clear here, is your dad's car (a) a second car in the garage and they searched it or (b) was it your dad's car you were driving?

if (a) your situation goes to the plain sight rule which means if they can see it they can check it. or (b) if it was the car u were in it falls back to the hot pursuit rule.
#8. you were fleeing if you left the sceen of the first stop.

you want someone on this board to help you get out of some mess you got yourself into...i.e. revoked license...why was it revoked? why were you speeding? better to learn how to pick your own fights and fight when YOU choose to do so. im not tryin to be a hard case but if your going to do this you need to build a foundation to work from and go from there it starts with studying so you will know for yourself what to do instead of asking others (although if i had to ask someone, i like you, i would rather do it here than other places i have seen.)

now, before you think im raggin your crack, reread this a few times think about what you see. now go look at the copies of the tickets you have. can you tear them apart like i did the note you sent? are you ready to bet your ass on your own reasearch? we all mean well but what if you lose?

I have 7 tickets consisting of: Speeding, failure to signal 2x's, not wearing seatbelt, fleeing from police, driving on revoked license and disobeying traffic control device.

I am more pissed than scared becuz i know under constitution i haven't broke a law. I am tired of traffic court getting away with criminal law.

How was i fleeing if i drove home in my garage on my property. They came on my property forced my garage door back up (left dents in it also) and arrested me on my property and searched my fathers car. I think this was illegal but am not sure. how did they know my license was revoked if the plates were in my fathers name.

Anyways just need some advice.

i know its not specifically i was jus jokin. just my first post introducing myself.

i had a dwi and lost in court three years ago. i never renewed my license so they revoked it(this was in north carolina.

people get slammed using the ucc that why i say crap. not saying it doesn't work it just might not in my case. I am a moorish american and i shouldn't use the ucc. As we are under a religious corporation/religious freedom filed in illinois in the 1920's.

i have just start studying the statutes of illinois.

the first stop never happened because i went home. do i not have a right to stop where i am comfortable? they never read me my rights. they never even once stated where they made their arrest which was on my father's property. My father asked why were they in his car they just closed the trunk and left.

i'm asking how the process in itself works i don't need anyspecific information because every case is different and it might not help me.

What they NEVER tell you is that prior to going to court you are entitled to an Administrative hearing. This document is worded so that it makes them prove the charges.

I finally got a ticket for no plates and registration. Sparks PD has a new cop from New Orleans and let me tell you I feel real bad for the folks in N.O. that have to put up with these types!!!

NOTICE AND DEMAND FOR AN ADMINISTRATIVE HEARING

To Whom It May Concern:

1. This is my formal notice to you that I am demanding my administrative remedies with regards to Citation Number $16706087758 issued in City of Sparks, State of Nevada on March 6, 2006. A copy is attached for your reference.

2. As you will instantly notice, said citation does not comply with the demands placed upon it by the relevant Nevada Revised Statutes and it definitely does not comply with demands placed upon the makers of the negotiable instrument as defined by the Department of Motor Vehicles.

3. Specifically, notice should be taken that there is absolutely no mention of administrative remedies demanded by the Nevada State Legislature of any governmental agency. Instead, the note accompanying the citation specifically directs the person to go to the Municipal Court of City of Sparks by the Municipal Court Judge. Even though that person signed the document, it is under that person’s letterhead so the person is quite aware of the fact that they are denying one and all the right to due process and equal protection of the law. This amounts to extortion under color of law, extortion under color of office and extortion under color of official right and I hereby demand investigation be made into this criminal activity in Washoe County. There can be no claim of ignorance of the law since that person is the one administering the law in that city. Your investigation will also probably prove that the City Attorney any deputy City Attorney, District Attorney and any deputy District Attorneys, the Municipal Court clerks, the District Court judge(s) and the District Court clerks are all aware of this which will allow you to assess RICO statutes to their enterprise since they are acting in their corporate capacity.

4. When scheduling the administrative hearing, I demand the following be presented to me at least thirty (30) calendar days prior to the hearing:

a. Written permission by someone with the authority to do so from the copyright holder allowing me to use the copyrighted materials known as the Nevada Revised Statutes.

b. Written permission from the copyright holders of WEST Publishing to use their materials in the preparation of a legal defense against this attempted extortion by officers and employees of Esmeralda County.
c. A certified copy of the oath by the person claiming to be OFFICER / COMPLAINANT CARTER identified as 7758.

d. A certified copy of the bond by the person claiming to be OFFICER / COMPLAINANT CARTER identified as 7758.

e. A certified copy of the personnel records for the person claiming to be OFFICER / COMPLAINANT CARTER identified as 7758 to allow me to determine whether this person has a habit of making false claims and filing false criminal activity reports, etc. with various governmental agencies in the State of Nevada.

f. A certified declaration of the name of the bond holder insuring the performance of the person claiming to be OFFICER / COMPLAINANT CARTER identified as 7758.

g. A certified copy of the impound record for the speed detection device supposedly used to quantify my rate of progress while traveling down Rock Boulevard in Sparks, Nevada preserving the chain of evidence of items used in the prosecution of a crime in the State of Nevada.

h. A certified copy of the impound record for the vehicle the person claiming to be OFFICER / COMPLAINANT CARTER identified as 7758 was operating on March 6, 2006 preserving the chain of evidence of items used in the prosecution of a crime in the State of Nevada.

i. A certified copy of the maintenance log for the speed detection device supposedly used to quantify my rate of progress while traveling down Rock Boulevard in the City of Sparks, Nevada preserving the chain of evidence of items used in the prosecution of a crime in the State of Nevada.

I still have to add a few things however I am sure this will help all who get any tickets.

Check out your ticket, does it say your are entitled to an admin hearing? It seems you only get that if you are arrested. However much discussion here and talking to my sheriff friend he says when you are stopped and told you are getting a citation that is an arrest.
