Injuction against the governor for travel rights

Anybody want to know what happens when a state attempts to interfere with the federal government's usage of the highways and byways?



View the case here...



Now, that is an interesting read, and a bit scary at first, considering the plutonium context.



But then I was thinking, why shouldn't I get an federal court ordered injunction prior to exercising my right to travel the highways and byways freely, without interference from the state governor and his agents, attorneys, etc?



After all, the federal government just did it! Why shouldn't I?

This is a blockbuster and should be used by all fighting traffic tickets!! This can be used--especially since the federal government was participating in commercial activity.

here's a question:



if the plutonium belonged to the Fed in the first place, prior to movement into/through SC, wouldn't that be considered "private property" and not a "commercial" activity?



if that's so, then the constitutional cite is definitely bona fide...



i'd actually be interested in a digest of the case before the decision to know the context/circumstances of that judgement...

Their arguments were based on violations of the Supremecy and Commerce Clauses of the Constitution, I do not believe the used a private property argument.

right away, and i haven't read but the first couplea paragraphs, i noticed the phrase "federal plutonium" (or something very like that as i'm not looking at it right now).



the way it is written, the plutonium belonged to the fed prior to movement - therefore it is private property, belonging to the U.S. and not really a commercial action.



right?

actually, whenever the fed wants to do something and the state tells them to take a flying leap--they always ALWAYS use that supremacy and commerce clause. But they look at you stupid when you try to use the constitution in your case.



We gotta get those bar card carrying member out of our system.
