Help with Ticket for Driving w/out License

My boyfriend was supposed to be appearing in court yesterday (Thursday, June 1) for a ticket he recieved for driving his motorcycle without a license.

He did not reserve his rights when he signed the ticket or sign under protest or under duress. He doesn't exactly understand the statutes, etc.

I would like to know if anyone else has beaten a ticket like this before and, if so, if you remember, could you provide an example of the argument you presented?

I understand that my boyfriend, being that he has not granted the court jurisdiction by getting a driver's license, retains his right to travel freely.

I also understand that, being that the traffic ticket states that you may be arrested if you refuse to sign (to contract with the state), his rights were violated under the Uniform Commercial Code which state that it is illegel for anyone to be forced into a contract.

My boyfriend, because he was unaware at the time, did not question the officer about whether or not he would actually arrest him if he refused to sign.

Also, my boyfriend is under 17. Will this effect his ability to argue his case in court?

Also, will the fact that he failed to appear the first time effect his ability to argue his case?

How should he argue his case?

What things specifically should he be sure to state?

What can he expect from the judge?

Even if he does notend up beating the ticket, this would make a great learning experience for me since I am considering rescending my license.

If a question like this has already been answered, could someone please point me to the thread?

PS He may also have recieved a ticket for not having plates on his motorcycle. How would he argue a case for that as well? He has not privatized his automobile. Will that effect his ability to argue his case?

Everyone needs to understand the difference between the matrix (government society) and reality (we are all sovereigns).

My suggestion to you and/or your boyfriend is/are to listen to Marc Stevens perspective.

I firmly believe his perspective, if applied correctly, will eliminate any misunderstandings.

Powder,

I appreciate your response. I have been browsing the site and even stumbled onto some other things of interest.

However, I am looking for something along the lines of a practical application of these facts in a courtroom.

Have you ever been issued a citation for driving without a license? Did you manage to have the charge(s) dismissed?

Even if you have not experienced that, have you ever "beat" a supposed traffic violation by applying your knowledge of statutory law, etc?

I am very interested in hearing of people's personal experiences with courtroom procedure and any fears or pitfalls they have encountered.

I have been browsing the forums to find some. If you know of any that may be of interest, could you point me in the right direction? I'm sure there have to be more than those I have already stumbled upon.

If not, again, I appreciate your response. Especially since, thus far, you are the only one to respond.
