Roads in ROW

I have been thinking that mabey the state is getting silent judicial notice that we are using their paved roads, not previously existing in common law.
I wonder if mabey we should sue the state for putting their "road" in our "Right of Way."
In exchange for their road clutter we would be demanding free use without limitation of such road.
I have thought about it off and on but never developed it much. Any thoughts??

Remember that the state is a creation of the people and the state exists for the benefit of the people; and all power of the state is inherent in the people.

So, how did the state pay for their pavement to be put on our rights of way?

Even if the state claims it came from the federal funding, from where did those funds come? And Who created the federal [govt] creature?

All source or origination of monies/funds is the same: of/from/by the people.

If you want to take it a step further, from where did the people get their monies/funds?

My theory is that "Right of Way" is my private Right to use a "way" of moving.
That the road is a public "thing" that is built and therefore is infringing on my private right to access the "way."
We all own the roads, as you are correct in that we created the state, but can this public thing be taxed because of that nature? I don't know. I will keep researching though and thank you for your post.
