I do not think so. I have an appeal right now trying to pin them down on the issue. I may have to lose one but I don't think I will. I have appealed and stated that the proceeding was an action and not a special proceeding. Actions are civil or criminal.
I feel that the proceeding in the tribunal is a special proceeding however and hopefully the appelate court comes clean. I would love to have that appelate case.
They may get me on a technical formatting error but if not... They should have some good answers for me.
I will post results on the thread. I think in Jan.
