If they don't want to call it criminal, is it then civil? If it is civil, can the state sue you? NOt that it matters, as it looks as though you have the laws backin ya up on this. (It ddin't quote what I wanted)

I do not think so. I have an appeal right now trying to pin them down on the issue. I may have to lose one but I don't think I will. I have appealed and stated that the proceeding was an action and not a special proceeding. Actions are civil or criminal.

I feel that the proceeding in the tribunal is a special proceeding however and hopefully the appelate court comes clean. I would love to have that appelate case.

They may get me on a technical formatting error but if not... They should have some good answers for me.

I will post results on the thread. I think in Jan.

Does your Cal. Const. Cover that? Civil suites by state I mean? I would be demanding this injured party be there!

Aside from a Terr. Action, I don't see how the state could make such a claim. Is the whole state (population) going to be there? Maybe your state can sue, just thought I would throw that out when you've seem to prove the voilation is a mere civil claim by the state.
