child support and the ucc
Hello all,
this may seem like an ignorant question, but i was attempting to use the ucc in a child support case to counterdemand evidence of authority and liability.
they have been ignoring my counterdemands and i've been "committed" seven months out of this year in the county gray bar motel for criminal and civil contempt. the attorneys are claiming the ucc does not apply in my case. they registered a foreign support order here for enforcement only. i have been wondering how much article 8 of the ucc applies to such a registration. they originally registered this order back in 04, despite my protests, and reregistered it in 05, despite my protests.
the attorney has also raised up the federal full faith and credit to foreign (child support orders, or judgments?) act, claiming the order is entitled to full faith and credit here.
i've heard of others using the ucc to defeat or discharge child support obligations but i am wondering how much the uniform commercial code applies in my case. i have read that the uniform interstate family support act supercedes the uniform commercial code.
in my case, i was taken advantage of in my youth and ignorance, like many, and was duressed into an "agreement". verbal terms were different than the written terms, and were breached (in actuality the verbal terms were misrepresentations).
there is no dna evidence, my signature is not on the birth certificate, i have never been a part of this child's life and do not even know if this child is mine. i do not believe that government should dictate to a parent what they should pay anyway, as it strikes me as a violation of the right of conscience. i do, however, believe in taking care of one's family.
so any discussion or comments would be greatly appreciated as i am here to learn all i can while i can!
