This might be a question that could be proven vital to the process you are undertaking.
Have you accepted any of their presements to you for value times one million dollars? Seeing as you have a TDA,you should do this and ammend the presement of acceptance to your ucc1 thru your SOS.& Have you done a ucc 11 search to see if there are any leins on property.
The only lein should be yours via your strawman.
Wells Fargo is playing a game with you ,you offered,
they refused. You might want to file their refusal with your county court house under misc. I would file copies of all papers on this at the court house. It just gives documented proof that you did send a bill of exchange and they refused. Also check at the county level also for any leins.

Thanks to all&!& all your responces are original& and they couldent hurt as far as& the presentments times 1 million i dont understand the theory behind that,& even after i have&looked it over&a few times.& &
There is no doubt i should have perfected my land patent before i started& but i was in trouble for a while& and i just discharged hoping it would push through& because i witnessed my friend having some&good news with her property discharges.& I was hoping they would just process it like hersand have the good luck she was getting. My lender is a small outfit& and probably cant process the instrument& ?.
Jerseee ,& i would just like to "update the landpatent"& but&it's not just as easy as updating if im correct& it takes a 6 months to a year of work& I got this from a girl that came to me for credit repair and she had just finished hers and it is a&lenthy process, and one I cant work on when they are at the front gate ?& unless you know of a speedy&way to get it done?& I wish there was a service that does those ! i havent checked yet//
Rushpat,& I know the& loan is discharged when the BOE is sent and thye allso sent it back to me with a& receipt of all the docs& that i mailed them& admitting refusal !! I thought this was my ace in the hole, but&again it's not that easy. They are moving forward with out even slowing down to review anything& my&last item sent& was a& contract addressing all the fraud that is goes along with mortgage loans im hoping this will null and void the contract with thier dishonor of no answer. So my question is& since it is discharged am i not able to show the judge& and say& here is is sir& tell them to&send my deed please!! suposedly they can get the collaterial back& and the& judge is always on the side with the matrix.&

Please review the thread posted by Don in regards to the Land Patent issue.& The land already has the patent, you just assert your rights in the patent.& The point is that BECAUSE THE LAND IS ALREADY UNDER PATENT THE COURT HAS NO JURISDICTION IN REGARDS TO THE LAND.

&They defaulted again >and have kept the whole enchilada since.
I have received numerous requests for payments in the form of standard payment slips& to letters from western&union& and other third party venders etc..&and its always the usual stuff saying im only 2 months behind (trying to get me to go back into contract)& They have called&I sent a notice of not to call& only contact by mail.
They sent me a&letter saying they were going to&start a pre-forclosure& on the 1st &and hung a door hanger on my door knob saying please call us immed.& and took a picture of it.(there office is out of state)
Most recently they sent me another letter saying "they dont except paper perporting to be a preauthorized transfer in lieu of payment" and all documents sent pertaining to this "Bill of Exchange" are being turned over to the FBI. More dishoner& I stamp all their dishoner "RETURN FOR CAUSE WITHOUT DISHONER" ETC..and return I am dealing with one person the "litigation Spe******t"
I then sent <U>them</U> a "NOTICE OF ERROR REQUEST FOR INVESTIGATION" in which they have only a few days left to answer.& I know which documents are next .
I just got a phone message from them asking if i would "please call them& they would make me a great deal refinacing&the loan with some great terms if i would just call "

A BoE is not a tender of payment, it is yet another expression of debt. The mortgage company has the right and power to refuse it and insist on money.

Unless you are tendering lawful money - even FRNs are nothing more than "yet another expression of debt". Read these descriptors carefully, noting this is in 1928 before the charter expired on all the Federal Reserve Banks in 1933.

I think a successful discharge, that actually put the payment amount on all four corners like a dollar bill... - oh excuse me Shoonra did I say payment? Should I have said expression of debt?
