Foreclosed Property
Good day "freedom fighters"
I have a major situation. I'm using the UCC process to fight my "predators" as well. I have my copy right notice, UCC FS, have sent all docs off including a Bill of Exchange to the three major predators that I am fighting. I'm still learning in this process but I seem to be losing ground.
In all three instances, my predators closed my accounts and foreclosed on my home, although a B.O.E had been tendered to them prior to the closings and the foreclosure on my home.
Someone informed me that I could go down to the county court and file a B-10 which would make the "predator" my mortgage company have to validate the alleged debt in court.
Is anyone familiar with this and what I will need to do to make this happen, or any other means to fight these "predators" on closed accounts and a foreclosure?

Re:Foreclosed Property
Question: Did you at any time attempt to assert your rights in the land patent before beginning the process with your mortgage?
Exactly what process were you using?

Re:Foreclosed Property
Thanks for responding so quickly. No, I did not assert my rights in the land patent before beginning the process with my mortgage. To be quite honest, I'm not even sure what the "land patent" is. I'm still new to the UCC process and unfortunately I was already up a creek, with no paddle, my boat had a hole in it and no life jacket when I started learning about this process.
What I did do was file my CRN, UCC FS, initially sent my treasury docs to the "predators", with a B.O.E. Yet they still forclosed and Ford Motor charged of my account and my credit union is threatening to close my accounts and charge of my debt. I'm still in my home but the mortgauge company has since attempted to get me to leave the property voluntarily by offering me moving expenses. Which of course I have rejected. I have since sent my treasury docs and B.O.E to Snow at the Treasury dept.
In Georgia, my mortgage company will have to go to county court to obtain an eviction notice to put me out. So I'm hoping and praying that means, that somehow I can make them validate the debt in court.
Any suggestions.

Re:Foreclosed Property
Suggestions? ... Well, I would punch the guy that got you started on the mortgage before you had asserted your rights in the land patent.& Check the download section for "Land Patent".& Once you have read it you will understand why I suggest this before ever attempting to discharge a mortgage.
The entire point is to STAY IN YOUR HOME... right?& The land patent protects you from "ejection" (nowadays they call it "eviction").
Find out what the patent number for your property is.& You may be able to motion to dismiss on grounds of the land patent BECAUSE a land under patent is FOREVER FREE of any government administration of any kind.& That means the court can't make any judgments involving your land.

Re:Foreclosed Property
LOL I can't punch the guy who got me started because he's my cousin.
I'll pull down the land patent info but the state of Georgia, I'm finding out is in the "Twilight Zone" when it comes to laws.
Thanks for the advise and information. I'll let you know what I find out.

Ice, I'm looking through the Land Patent as we speak. Where do I go or Who do I contact to find out my property patent number?
FYI
Ice was my old nick name in college

Re:Foreclosed Property
Check with the Bureau of Land Management. I had the address but cannot seem to locate it at the moment... I believe they are located in Virginia.& Search for their website.
By the way, Patent Rights Exist regardless of any factor of claim (But make the claim anyway).& And, if you end up in court for foreclosure, request the ORIGINAL NOTE.& This would bear the hand written signature... no photo copy.& If they cannot produce the original note... Move for Dismissal.& A photocopy is not your signature... and you must vehemently make this point.&(It may have the "form" of your signature but it does not have the "substance").& There is all kinds of stuff to know about mortgage situations... there is a lot to learn.
(Cousin?& Correct me if I'm wrong but wouldn't that give you even more right to punch him?!! haha)

Re:Foreclosed Property
Great info Ice. Punching my cousin is debatable since he is the fellow who introduced me to the UCC process. He may stop mentoring me if I did that. LOL We are kind of learning it together.
Ok, looks like the Land Patent can be found at the "Recorder of Deeds" office for the county that you reside, wherever and whatever that is. Maybe you can answer a few questions about the land patent. I read it pretty quickly so I could post you ASAP.
It appears that the Land Patent supercedes all other docs "claiming" ownership. The land patent is on the land not the house which the lender/banker owns. One, does the land patent supercede the lender/banker real property in the house? I'm also a little confused on who actually owns the land patent. Is it the state or the government? Obviously, I don't own it. So how can I use it to keep from getting evicted?

Re:Foreclosed Property
You'll have to go and see who has the patent on the land... I'll tell ya this much... it ain't the government -- it's a SOVEREIGN.& You will be asserting your right in the patent as an "assign".& Now, here is the really tough part for the bank... they may have a mortgage on the house... but they don't have the right to step foot on the land to take the house.& Nor does anyone have right to step foot on the land to put you out of the house.& So... is it starting to sound like the bank made a bad business deal ??&
Once you assert your rights in the land patent -- you "own" it.
