Hey Jerseee!!!!

Oh you are right however if you use someone else to mail it via USPS then you have two disinterested third party witnesses one of whic can write an affidavit and testify to it in court that it was mailed.

I use a Notary for mailing and include a certificate of mailing signed an notorized. I use a Notary Acceptor for receiving the reply. If no answer then I get a Notice of Non-Response from the Notary Acceptor, with their notorized signature.

The USPS and two disinterested third party witnesses that will testify in court if need be.

Kitchie,

I think you should read the thread, "Misuse of Notaries". this is something I would not suggest to do........to use a notary as a postman/woman.

Thanks for the heads up, but I believe I am OK on this.

The notary acceptor in this instance is not a postman. They are the person to whom the libilee must respond so I have an officer of the court, disinterested third party, that will be able to testify that there was no response from the party addressed. My Notary that actually mails the do***ents is doing so in private capacity with her signature acknowledged by my Notary Acceptor.

When the Notary does not get mail from the other party a simple notice of non-response is sworn to by my Notary Acceptor.

My job is to make sure there is nothing that can harm my notary!!

It's the Notorial Protest that you have to be careful of.
