Re:COLLECTION INFORMATION NOTICE - FTB 1140

regarding the legal contract, my brother, an attorney/lawyer had this to say:<FONT size=2>

It seems a bit bizarre to me, and not at all like a standard retainer agreement between lawyer and client. I also am unclear why it has so many qualifiers and phraseology in it if it simply is intended to be a contract for legal services. There also are some critical issues missing such as payment of fees, billing arrangements, etc... Further on that, I am a bit unclear what an "Assistance of Counsel" is. Based on all this, I would be very hesitant to sign that document.

hth,

Re:COLLECTION INFORMATION NOTICE - FTB 1140

It isn't a retainer agreement... it is a contract for assistance of counsel... as opposed to an attorney being an "agent".& There's a big difference.

The attorney works for THE COURT... and the client comes last in line.

This agreement is used to put the obligation to assist the Client FIRST... and everything else LAST.

Truth is, I don't think any attorney would make this agreement due to the fact that his/her&allegiance is to the COURT.

Thanks Jim for the contracts.& I will look into those.

Thanks jmunson.& It is good to know what at least one person we could contract with has to say about it.

Thanks to everyone and I will be focusing on new thread about suing banks under Banks, Collectors, and CRAs.
