Breach of Contract (Mortgage)



Hello everyone,


I am new to this forum and the discussions are very helpful. I currently have a situation regarding my mortgage. My mortgage payment includes the principle, interest, insurance and taxes. This is what my mortgage originated with. My original mortgage company assigned my mortgage to another company. I am making the same payment as the original. I received a notice from the tax assessor's office stating that my tax is dilinquent. The new mortgage company has not made the quarterly tax payment. Now since this tax was covered under the note and the new company is not making payment, isn't this regarded as breach of contract? I look forward to some brotherly and sisterly advice.

The original contract was based on fraud in the first place.* And yes, not only a breach of contract but a breach of fiduciary duties and trust.* You are in a good position.



When dealing with mortgage problems, my first suggestion to anyone is to secure their rights in the land patent.* From this point on -- you are in control.

Yes, it is a breach of contract... but there is a bigger fraud going on...



In your situation you could sick the gubmint on the new collector... and they will go after them tooth and nail. You may actually have a gold mine on your hands. The gubmint might actually help you with your breach of contract issue... and that could get you out from under that mortgage. The gubmint is your proof of the breach of contract. The payments have not been made and somewhere, someone is violating something... the gubmint will want to look into that.
