Hey I left this post a few days ago and come back to see this! Seriously, I hate to admit it, but from the "ahem" debates like these comes the best teaching. I have learned so much from threads like this one.
Thanks for all the help and i will be sending a letter to Wells Fargo.
On another note, Jersee I read of your successes and your offer to help Tora or any other member to understand your process with creditors. I openly ask for some guidance in this matter. I have several credit cards that hounded me so much i had to change my phone number. Now I just wait for either jubilee to kick in or the next process server to tap at my door.
I would be obliged to have help in any way. And so as to not tie up the forum with my personal things I would offer either PM or e-mail as a mode of communication.

thank you for the compliment and you have experienced what the forum is truly about.& And if you would like to know more about how my process works, read some of my threads in the "Credit Reoprting Agencies" forum.& In there I give the essence of my process and it is so simple and so cost effective.& Last week, I spent a whopping $1.11 on postage and I expect a positive response within 30-45 days!


Once you have read those posts that I did last month and in January....you can either post your request here so, others may learn or you can private message me.& if you would like a second opinion before trying my simple process you may ask others in this forum that have used my approach.& And you will get tired of me saying this to you, "never argue".&


I repeat that statement for a very good reason--just ask Montana!& :-)& hahahahahaaa& But don't mention anything about cookies to her.& (inside joke)


Anyway,&I would be honored to assist you in anyway possible strawman.

the method I used to get those fools (debt collectors) to cease was fairly simple....i guess you know what i am going to say?& I didn't argue with them.& I just agreed and sent them a CN and told them, that they need to verify the debt with their client before contacting me again.& Of course I cited the code in the letter as well.& And that $4.42 letter--stopped all correspondence from them and the "alleged" original creditor.


Now, Big Sky, the reason that the debt keeps getting assigned is that you need to do a VOD to the Original thief and just notice the third party thieves.& but your silver bullet in this situation is the CRAs.& once you contact all 3 CRAs and demand that they verify the debt according to the code--watch the fireworks after that.& Because now it is not just you asking for certified verification--it is a public, disinterested third party asking as well.& Do you see how simple it is?& Do you see how cost effective that is?& The VOD may cost you about 10-15 dollars (notary, copies and postage).& the letters to the CRAs will cost you $1.11 (3x.37).& And then another .37 to the third party thieves (letter and CN).


I did this everytime and now, I do not get those kinds of letters any longer.& I hope this helps you in some way

Strawman,

My process is so simple. It is not based on anything that I created or conjured up like these other packages that some organizations are selling. My process is based on their responses to me. That is all! I do not allow them to get off-track and then lose my position once I have put them on notice of the code. Stick to the code and repsond accordingly to their responses to you. That is the order of the docs.

If you initially write them and then write back withsome mumbo jumbo, you keep them to the code and do not argue with them. Read the code and keep citing the code that they are to follow. Also read the code that punishes them if your instructions are not followed.

You are the King! You have the power to reward them and punish them--through the code.

most states have statutes saying that a debt collector can only collect the amount he paid for the debt. So one of the demands I add to the debt collector letter is "Certified accounting of what you paid for the debt."

that is a viable option but, I want certified verification of the debt first.& then we can talk about the accounting later providing that they can prove that the debt exists in the first place.

I have a question...


EDD (Employment Development Department) is billing me for $588.& They claim they overpaid me because I was offered work that week but&I&refused it and made a claim anyway,&which is true, but I had no earnings that week, so&that's why I made the claim.&They are punishing me because I did not accept the work.& The debt has not gone to a third party debt collector and I don't know if it&ever will. &My question is this:Can I&request VOD when the debt is&with the original creditor?&I don't know if it will ever&go&to a third party debt collector.


I sent them an "assignment of interest" UCC-1 document to discharge the debt, but yesterday they called and left&a message&saying, "We know you went through a lot of trouble getting these papers together, but they are not valid. Please send us a check, or money order.& Please call us if you have questions!
