Ahhh Jerseee... noth'n better than crotch codes; a.k.a. the short-hair symphony!
Yea, been a little busy... This whole CRA thing has taken up a little time but I "think" we may be onto something re fixing the commercial record as attorney-in-fact, agent.
The bond/ affidavit thing is very cool. We recently used it on a mortgage and got the property in a little more than 45 days!

OT,
Congrats again.& I am assuming that it is the property that we spoke of earlier this year in the east.
Anyways, I will be getting in touch with you after I am settled in Texas.& tenatively in January.

Actually the property we spoke of was completed in September. Our latest one was an experiment using the bond process.
We like the bond process much better than using discharge instruments. Addressing the fraud in the contract is effective because the "argument" not is over "kind" or "specie" of payment rather the dishonesty or lack of disclosure prior to the "contract" being signed.
Keep in mind that a contract must have all of the material facts present prior to the parties entering into it. Any material fact held back or suppressed for the benefit of one and not the other creates an inequity and is therefore dissolved; vitiated.

OT,
Interesting.& I did not think to search that area, even though its should have been noticed first.
Also, don't forget to include: misrepresntation, mistake, unjust enrichment, negligence, etc...& Oh boy, we could go on and on.
A question though, does this impair your ability to to get a new mortgage on a new property or refinance the current property?
I would think not but, one never knows until they ask.

Not at all... Once the property has been reconveyed, in addition to removing any other filings that prohibit the title from being clear, one is good to go.
We are in the process of re-financing (financing?) the first property we ever discharged.

As a follow-up to our posts, I just received the official title report on my property- it's CLEAN! No sign of the mortgage company anywhere... Truly a bonanza!
