Current method of UCC filing

There is a debate raging in other discussion forums about whether or not to file your security agreement with your UCC-1 FS.

Some say that the UCC-1 is just a notice of lien and that listing an SA on it isn't good enough, so they are advocating attaching the SA to the UCC-1 for proof to 'put more teeth into it'.

I thought that was a no-no. Any ideas?

Do not file your SA with your UCC.

This issue was settled long ago... do not file any of your personal docs with an FS AND

If you use the CN with the VOD you do not include your pirvate docs with the mailing.& If you do include them you&may later have to include them in any UCC filing you do against your "target" so that you have a complete record.

Re:Current method of UCC filing

Correct me if I'm wrong but shouldn't the SA be accepted 4 value then deposited with the Treasurer?

Its still on the private side because we only deal with the flesh and blood, J*** W****** S****.

Plus, the credits (or money the STRAWMAN owes us) is added to the UCC contract Account (TDA) where it rightfully belongs.

I haven't done this yet, but I believe I'm hearing from Angelic Beings on this one. Anyone, please....

I HAVE TO RELY ON THE MOST HIGH FOR ALL INFORMATION BECAUSE I SENSE THE HESITATION OF THOSE THAT KNOW, THAT STILL HAVE TROUBLE SHARING.

4Integrity,

Keep it simple. And welcome to the Fourm! :-)

When I say keep it simple, I'm not trying to insult you. What I am saying is this....I do not understand TDAs, I have not done any research on them, hence, I do not use them.

I do not send anything to the Treasurer.

Whenever, someone or some organization writes me and says I owe this and that--I respond appropriately to the letter with honor.

I do not send public or private documents out (unless I have to). I cite US Codes and statutes in my correspondences. If they cite a Federal code to me, I cite one back to them and I offer a good faith payment if they can prove their claim.

Different situations call for different responses but, however different they are---I keep it simple and never argue.

Re:Current method of UCC filing

Great point Jersee,
Received and Accepted, resepectfully. There are many methods and they are all effective. Thank you.

Question: Have you had any problems filing in NJ?

Re:Current method of UCC filing

4Integrity,

yes, i have had problems filing in NJ.& So i just filed in WV.& However, I keep the rejection letters as evidence against them someday.& for this reason if i am damaged in anyway by them I have their refusal to file my UCC1.& Furthermore, i have filed other UCC1s with other states without any problems.& All are the same and nothing was changed.& the reason NJ refuses can be many that they do not disclose but, I am always told that they cannot determine who is who (meaning the debtor and the SP).

i do not argue, I only ask questions and leave it at that because now i have their testimony to the bogus refusal.& It is not their job to determine who is who--they are only suppose to file the claim and to make sure all the information is properly filled out.& so now they are making legal determinations--hence they are working outside of their bond.& Most folks would go right after them for doing so.& i choose not to do that until I am damaged in some way because of it.& then i would move from there.& I usually let folks or organizations fall by their own misdeeds.& There is no pleasure (to me) by attacking all the time.& That is just too much work.

i know that this was rather long but, NJ not accepting my filing has been a sore spot for me; however, I maintain honor and wait for the day.

Re:Current method of UCC filing

Jerseee,

You might have already tried this but crossfiling might work.

Montana wouldn't accept my UCC but they told me that if I changed even one of the letters of one of the names they would accept it.& So, they gave me a remedy.& (I didn't do it that way as that would be silly.)&

I went in person to the Secretary of States office.& When they told me that I couldn't file that kind of lien I asked them to provide me with the code stating that.& They came back a couple of minutes later with a code saying that they could refuse to file fraudulent or inappropriate filings.& I told them that I didn't see where that applied to me and they said that they could make that call because they were the Office of the Secretary of State.&

So, I left and called a couple of good and knowledgable friends and went about it through what&has been&referred to as crossfiling.

It was a great feeling to walk back into the same office with the same people and have my filing accepted.

Re:Current method of UCC filing

Montana,

I thought of cross filing and I may try it. But, I really want to stick it to NJ somehow (one day). Actually, I want the actual individuals that refuse it--not the whole state. thanks for the reminder anyway.
