From one debt collector to the next...
Hey all,
I have read somehwere before that there is no law that prevents different debt collectors from subsequently attempting to collect after&another fails/terminates in the collection attempt.& If this is true,&is there an easier remedy than repeating the VOD process over and over again?
Any&thoughts of incorporating new self-executing contractual clauses in the current VOD process that may prevent this from happening in the future? Or is there one already that I am unaware of? Thoughts?

I don't think there is any law that prevents a debt being referred from one collection agency to another.& In 2000 my husband and I terminated $35,000 worth of credit card debt and they have been turned over from one collection agency, back to original CC company and to lawyers and back to the CC company again so many times I have lost count.& We are still getting letters from collection agencies and lawyers etc.& I've quit responding to the collection agencies.& I only respond to the attorneys.& Three of the attorneys have taken us to court.& We only went to court on one and the attorney for Sears didn't show.& One of the other ones was dropped after I sent a discovery letter, and the other court case wasn't able to serve the papers.& We found a note from the sherriff to come to the Sherriff's office to get some important legal papers twice, and we never went to get them (like we would come to be voluntarily served!), and so far haven't hear anything else.& After the court case with Sears we even got an offer from Sears to settle our debt for about 25% of the original debt.& Once the original CC company turned the debt over to a thrid party it was void, so I just don't worry about it anymore.& Only the original CC company can report it to the credit bureau.& And thanks to some of Jersee's posts the CRA's can be dealt with.

Whirlwind that is funny. I am currently writing an e-book and one of the chapters is called, "DEBT COLLETORS: THE CLOWNS OF COMMERCE".
Your post is a good example of why debt collectors are a joke! They usually buy the account and then try to get you into a new contract at a discount. All the while, you are being damaged by the original CC on your comercial person's credit/debt report.

Get the CRAs involved and discharge the orginial Creditor with a modified VOD to fit your situation. So get the evidence from the CRAs to show that the debt is unverifiable (never argue or do a dispute letter, simply tell them to verify the debt according to the code) and then you can start laughing at collection agencies just like I do.
Do my critical reading test that I posted in the Citizenship and Jurisdiction Forum of this site and then start reading those notices that the debt collectors send out! they are really funny! They put an offer in with the verification process. So if you argue, you have just retained them to represent you and you unknowingly admit to the debt since you are now represented by them.
The disovery process is a viable option as well and just as potent!!! Hell, I wouldn't show up to court knowing that I could possibly go to jail just to try to collect a fraudulent debt and the mark has sent me a discovery letter before going to court!!! Geez!
But the route that I go Squirrels is, I want them to come to court so, I can attack them with their own evidence and possibly get damages awarded if I so desire. I put them on notice of my CN throughout the whole process. And my CN is registered with the Secretary of State at the UCC division along with a DBA. How's that for genious? Hahhahahahaa, would love to see the look on their face after that hearing--if I ever have one. hahahahahhahahaaaa

We even had one collection agency that turned our account over to another collection agency- not back to the original company.& I still wonder what that second collection agency was using for brains.& Were they actually buying the account from another collection agency?& Some of the original CC companies have sold our accounts to 7 or 8 collection agencies.& One of the things that& they say that I love the most is when they want you or your attorney to contact them-immediately.& They think that really scares us.& Oh well, I guess they really needed a job.

Can they do this?
A collection company came after me I sent them all the paperwork from the Unsecured Debt resolution pack and they sent me back nothing.
Six months later I receive a letter from another collection co. After doing the same as with the first one no answers. Then along came a new co. so I tried to find out whom these co. are and low and behold it is a Corp. and all three companies were a part of the same Corp.
