Thumbs up A Victory in the making!!

I have shared in the past about a friend here in Florida that has tendered a BoE in her criminal traffic case and it has been ongoing now for over 18 months. Well, I just got word that the judge in open court advised here that he had to set a trial date, but that he believed the charges would be dropped and she would not have to appear for trial. This after the attorneys approached the bench and the prosecutor advised the judge of the State's intention to drop the charges. This could be a major victory folks. I am not saying it is definite, but looks much like this is what will happen. I will update everyone when the decision is in.

The judge had the entire case file in front of him this time. Her straw-woman had been appointed another attorney and when my friend met with that attorney for her pre-trial hearing today this attorney was very antagonistic and when the attorney started to talk at the podium the judge stopped her and had both attorneys approach the bench and then made the announcment. This is too cool!!!

I will pray hard for you to win this case and then pick your brain on how to do a proper BOE so far I only heard of people being jailed for it. So, I don't totally understand why mine in not good or works. Let me know please very interested here. Thanks and wish you well, Bobbie

There is a little more to this than just the tender of the BoE. This lady has remained in honor the whole time. I have been to the court regarding her case myself many times. They have tried everything to get her to give jurisdiction and she has not done so. The court has not known what to do from day one. They had her take a psych eval, brought family and child services in to evaluate her and asked her leading questions in court and she has handled herself very honorably. She has always referred to the defendant's counsel as being the one that the questions should be directed to, since he represents the defendant. She has been incredibly focused listening to every word and then responding appropriately.

What has been great is that the court appointed an attorney (fiduciary) for her straw-woman (legal fiction) from day one. She has educated this man and he has taken a special interst in this case. He was then moved up (promoted) and my friend was given this new attorney (fiduciary) and is my opinion it was done to try to trip my friend up. Well, that did not happen either. The other attorney has stayed involved because of his special interest in the case and he a sincere desire, IMHO, to help her settle and close this matter.

She has been hindered from being able to get to work as a sugeons first assistant (I believe that is what it is called) in a trauma unit. She works in the OR helping the head surgeon and he depends on her quite a bit. It will be good when this is all over. I will tell you we can all learn from this lady on how to remain in honor.

Lady in Honor

Has this lady had to remain in custody in order to stay in honor and keep from giving jurisdiction or being adjoined?

My prayers too.
