Check out the Texas SOS's site for Reasons for Refusal, and see if your docs are in line. It may be that a single change is all that is needed. Sometimes, they don't like to tell you how simple it is.

Also, the FAQ's page may be helpful, as well as, the types of documents accepted for filing.

The other course you may take is to look at Sec 405.021. FILING OR RECORDING OF FRAUDULENT DOCUMENT, and see if it really applies to you. It may be that they're misapplying it to your filing as a stall tactic, and if you can quote one of their other codes to call their bluff, they may accept it. Without knowing how you filed, it's hard to speculate.

One other path you may take is to request assistance (information) under the Freedom of Information Act (FOIA) as to what exactly was wrong with your filing, and how you can correct it in their eyes (with their codes, rules, and regulations).

I had no problem filing my UCC in Texas. However there is a new SOS. Remember "they" dont have one filed on you, so review from a commercial process how "they" got JD in the first place. This may serve you later!

It is only a NOTICE. The real issue is a lien which can be attached to verify the existence.

Winston also refers to a real lien being the old state form. We/I have'nt tried using it yet, however its on our list for the near future.

Ultimately, you must notice them who you are and what their responsibilty is. Many times they contradict themselves. This is becoming apperant as many states have delagated the recording responsibility to a private corp.
