Chapter 11 is also a powerful tool, if used correctly. It places your property in trust, and you can use discovery process to demand proof of claim from whomever is making the claim. They have to sign the proof of claim (B-11 form I believe) under penalty of& 5 year/500,000 fine.
Even if they can swear out the proof of claim (they cannot), then they still have to show that they lost something!
I started listening to the Winston Shrout audio located under the seminar section of this site, and it holds more details on this process.
But I would first focus on the land patent. If it comes down to the wire, I would then consider the Chapter 11 as a last resort.

Happy Studies? This will be the most intense, crash study course that I have done of all time.
I went out to BLM and like I have been saying Georgia is still living in the Dark Ages. There are no land patents for GA. It's not even listed on BLM and it states that if the state is oulined in white, it doesn't have them currently.
I'll check on the Ch 11 but due to some other ch 13 problems that were dismissed with prejudice, I might not be able to file for another 2 months. I don't think I have that time.
So looks like I'm going to battle with proving HJU 192, UCC 3-603(b) and the debt is discharged. Plus the Floriday case won with the B.O.E.
Does anyone have any success stories for GA that they could point me to.

considered part of the Federal lands acquired during national expansion.
Therefore, we do not maintain those land records at the Bureau of Land
Management’s Eastern States office.& A “patent� is an instrument by which the United States conveys legal title to public lands, and Georgia was never a part of the Public Domain.& I can send you som&handouts on land records, if you would provide me with your mailing address, there is no charge for the information.
Inquiries concerning land records for these states should be directed
to the appropriate state archives or land record offices.& The 18 eastern
non-public lands states are Connecticut, Delaware, Georgia, Kentucky,Maine, Maryland, Massachusetts, New Hampshire, New Jersey, New York, North Carolina, Pennsylvania, Rhode Island, South Carolina, Tennessee,Vermont, Virginia, West Virginia and the District of Columbia.& The western non-public land states are Hawaii and Texas.

That is wrong. The letter is dead wrong. I recently asked my aunt in North Carolina to do some research for me and she found it.
This has nothing to do with national expansion--it is private. You may have to go back to the constitution of Georgia. And if history serves me correctly, the 13 colonies were established before the UNITED STATES was.
So how can the corporation even be in a position to pass title or whatever mumbo jumbo she is talking about. You may have to go to the court house and read up on some case law in this area.
