UCC 1-207 is now UCC 1-308

Looks like they've continued to change the UCC.

I couldn't find 1-207 anymore, but it is now part of UCC 1-308.

§ 1-308. Performance or Acceptance Under Reservation of Rights.
(a) A party that with explicit reservation of rights performs or promises performance or assents to performance in a manner demanded or offered by the other party does not thereby prejudice the rights reserved. Such words as "without prejudice," "under protest," or the like are sufficient.
(b) Subsection (a) does not apply to an accord and satisfaction.

This is very interesting.& I was able to find it another way, but you are right.& It is not in the link that you provided.& As if it wasn't already confusing.& They must be getting more scared that they have to do things like this.& If you want to see where I found it follow the link.&

Hmm... your link has 1-207. Mine has 1-308, both say the same thing. Which is newer?

Does it matter?

Well, I was making my Refusal for Cause Without Dishonor letter to the CA FTB, and I was looking over other examples as a guideline. I was looking up the UCC references they had, but many had been changed, from what I found at the cornell.edu site. I can only guess that the changes took place recently.

In my last correspondence to the FTB (a few weeks ago), I used the UCC1-207. On this new one, I'm using UCC1-308 to show that I'm using the updated versions, so they don't think I'm using boilerplate versions that others have used. I also updated the UCC reference numbers that I've used throughout my document.

I'm not sure if this will help, but, I bought a 2003 UCC and there is no 1-207, under 1-308 is the Performance or Acceptance Under Reservation of Rights.

Yeah, it is a bit confusing to say the least.& I also own a West's 2003 UCC book, and I know of what you speak.& The revised Article 1 in the front of the book is correct (nationally) - 1-207 has been changed to 1-308 (since 2001!).& The old Article 1 (1-207) is located in the middle of the book at Appendix P. However, depending on the state in which one resides, the old Article 1 is still good law as the new Article 1&may not have yet been approved (such as in Calif., where 1-207 is still good law, although I have not recently checked to see if the revision has yet been approved).& Every state has a&nearly identical&version of the UCC national, so whenever one uses UCC in their home state for a state issue, one must consult their state UCC to see how applicable it is due to any modifications that may have occurred.&

Excellent hint squirrels, also be advised that any refrence to UCC1-207 or UCC1-308 will automatically subject one to "federal" association. (ie;inside the "Federal Zone").


Best to simply use: Without Prejudice-All rights Reserved


or&reference to your&state's (ie;outside the "Federal Zone") specifics re the UCC.&


P.S. For those who have yet to check the "links" section, or visit the Supreme Law Firm's web site, a valuable addition to one's library would be the purchase of: The Federal Zone, from that site, HIGHLY RECOMENDED!!

Signing "All Rights Reserved" is sufficient for us common law type folks.
