how do you cancle a UCC-1 ??

would anyone have any clues on how to properly cancle a UCC-1 FS.

I went to the Secretary of State website here and it mentions several times termination of a financing statement. However it provides no form nor information on how to do so.



Maybe the SOS in your state will have more information.

Using a UCC-3 addendum form, there is a spot for termination. It's a place to put a checkmark. Look into the LIEN REMOVAL thread here:

There, you will find a link I put up to the Arizona SoS site where you can do a search on a guy's name and see how he got rid of the IRS Notice of Lien on file.



However, you may have to provide documentation on why it is being cancelled, if you are not the Secured Party. In that link, he provided an unrebutted affidavit on why it should be removed. I'm not sure who'd make the decision to honor it, but it is definitely possible.

Thank you very much. I talked to my friend today and he told me the sos for minn recorded the ucc-1 and put the straw man as the secured party. Even though it was plain to see that the secured party was spelled in upper and lower case letters on the ucc-1, the return statement showed the secured party in all capital letters. how pathetic can these so called selected people who pretend to be working for the People be. this is just another example of what these treasonous traitors will do. IF YOU WANT OUT, CANCLE ALL CONTRACTS IT'S THE ONLY WAY TO GO. But be warned, you will never find a job because the people in this country are to ignorant of the "LAW" to know you dont need a # to work.

Isn't the UCC-1 the official recorded filing with the sos?



The return statement that accompanies it is just that - a statement that it has been filed.



My thought would be that the UCC-1 filing with the flesh and blood spelling as the secured party is the true recorded copy. I believe that this is the 'legal' filing - not the statement that it has been recorded.

The UCC 1 that has been filed that has the upper and lower case flesh and blood man/woman listed as Secured Party is what you go by. Here in Florida they sent the Acknowledgement the same way in the ALL CAPS name. The computers know no difference. As long as your recorded copy shows the upper and lower case Secured Party you got no problem.

I see it as a scam pure and simple. things were just fine under the brushears method, then he filed this load of crap and it seems to nullify everything he did. so now he's working on an affidavit to cancle out what he just did. We found out the hard way, you cannot play in the devils playground you will lose everytime, it;s their rules and they can and will change them to suit their needs everytime !!!!

In Illinois the SOS will not accept any UCC filing unless it is ALL in uppercase. I got one through with the proper spelling/capitalization but all the others were refused several times.



Of course UCC 9-403(1) says that presentment of the FS and tender of the filing fee constitutes filing in fact whether it was accepted or not.
